That'll depend on your state's requirements. Some go by year, some don't even care. If you have to have it inspected now, could be a problem. But there is "smog" 289 heads out there. I had a factory set on a 66 Stang I owned many moons ago. Nothing wrong with the smog heads. Just have to grind the smog bump out and you can still run a smog pump with it removed. The casting bump was made for air flow direction control and ease of drilling at the factory.
